According to court documents, 23andMe falsely and misleadingly advertised its Saliva Collection Kit/Personal Genome Services (PGS) kit as “providing ‘health reports on 240+ conditions and traits,’ ‘drug response,’ ‘carrier status,’ among other things when there is no analytical or clinical validation for the PGS for its advertised uses.” NBC News reported that plaintiffs are also accusing the company of marketing the genetic samples to scientists for research.
The lawsuit was filed just days after the U.S. Food and Drug Administration (FDA) sent a warning letter to 23andMe, advising the company that products used to diagnose, mitigate, or prevent disease need FDA clearance and demanded that 23andMe stop selling its PGS kit. The FDA warned 23andMe that it may be forced to take legal action against the manufacturer if it did not immediately stop all marketing for the product and submit clinical data supporting the kit’s accuracy. The FDA also expressed concern that a false negative or false positive reading for certain genetic risk factors or diseases could cause serious health consequences for users who rely on these results in seeking medical treatment.
