Mirena MDL Does Not Prevent Those Affected From Continuing To Act

(Medical-NewsWire.com, August 01, 2013 ) New York, NY – In early 2013, around 40 lawsuits alleging that the Mirena IUD had caused women harm were consolidated to a federal court. This consolidation, known as a Multidistrict Litigation (MDL), means that one judge will coordinate pretrial proceedings, saving time and money, and expediting the legal process. A separate MDL has also been formed for more than one hundred cases filed in New Jersey. The federal MDL will be heard by U.S. District Judge Cathy Seibelin for the Southern District of New York, while the New Jersey MDL will be heard by the Superior Court of New Jersey, Bergen County.

These actions, however, do not affect the rights of women who have experienced side effects following use of the Mirena IUD, but who have not yet filed a lawsuit. Women who have experienced side effects associated with Mirena may still have legal recourse to seek compensation and take part in lawsuits against the manufacturer. These women will only have a certain amount of time to file a claim, depending on the statue of limitations in their state. The Mirena intrauterine contraceptive device (IUD) is a T-shaped hormone-releasing device, placed within the vagina to prevent pregnancy for up to five years. Some women have reported ‘migration’ of the IUD, whereby the device moves from its intended position. It has been alleged that this migration can lead to potentially serious side effects, including organ perforation. This occurs when the Mirena moves into the abdomen, which can also lead to scarring, bleeding, and discomfort, according to suits against the IUD’s manufacturer.

Other reported complaints include abdominal pain, uterine embedment, and device expulsion. The Food and Drug Administration’s contraindications warnings for Mirena include ectopic pregnancy, sepsis, ovarian cysts, and perforation.
